Carevazo Terms of Service

1. Agreement
By creating an account or using the Carevazo mobile application or related services (the "Service"), you agree to these Terms of Service ("Terms") and our [Privacy Policy](./privacy.md)Privacy Policy./privacy.md. If you do not agree, do not use the Service.
If you use the Service on behalf of a care recipient who is a minor, you represent that you are their parent, legal guardian, or otherwise authorized to provide consent for their care coordination.
2. What Carevazo is (and is not)
Carevazo is a family-first care coordination tool. It helps families and invited care team members organize profiles, journal entries, handoffs, and related information.
Carevazo is not:
- A medical device, healthcare provider, or clinical decision system
- A substitute for professional medical, therapeutic, psychiatric, or emergency services
- An emergency response or crisis service
In an emergency, call 911 (or your local emergency number) immediately. Do not rely on Carevazo, emergency handoff links, or AI-generated summaries for urgent or life-threatening situations.
AI-generated summaries are informational aids only. They may be incomplete or inaccurate. You are responsible for verifying important information with qualified professionals.
3. Your account and responsibilities
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
You agree to use the Service only for lawful care coordination purposes and in compliance with these Terms.
You may not:
- Access data you are not authorized to see
- Share care information outside your care role (providers: see Section 8)
- Attempt to bypass access controls, scrape the Service, or interfere with its operation
- Upload unlawful, abusive, or infringing content
4. Care recipients, minors, and self-advocates
- Care recipients under 13 do not create their own accounts. A parent or guardian manages their profile.
- Care recipients 13 and older may be invited to create a self-advocate account with controls described in the Privacy Policy and in-app settings.
- Information about a care recipient belongs to that person and their family. Carevazo provides tools for families and authorized care team members to coordinate — we do not claim ownership of your care content.
5. Care team sharing (user-directed)
When you invite someone to a care team or create an emergency handoff link, you choose who can see information and in what role. Carevazo facilitates that sharing; it is not a sale or marketing disclosure of your data.
You are responsible for inviting appropriate people and reviewing their access. You can remove care team members and revoke links subject to in-app controls.
6. Data use — no sale; limited aggregation
We do not sell your personal information. We do not share your care records, journal entries, or profile health information with advertisers, data brokers, or for third-party marketing.
We do not sell aggregated or de-identified information to data brokers or advertising networks.
We may create aggregated or de-identified information that does not reasonably identify you or your care recipient. We use such information to operate and improve Carevazo, understand feature usage, and produce high-level statistics (for example, total journal entries logged in a month).
Optional programs: If we offer research, partnership, or public reporting that uses de-identified health-related content (not just usage counts), we will ask for your separate, explicit consent before including your information. You may withdraw that consent at any time.

7. Subscriptions, trials, and billing
Carevazo offers free and paid tiers per care recipient. Feature limits, trials, and pricing are described in-app and may change with notice as allowed by applicable store rules.
- Free tier includes usable coordination features with certain limits (for example, care team size, AI summary quota, journal history window, and handoff links).
- Pro tier unlocks additional features per subscribed care recipient.
- Promotional Pro trial: Where offered, you may start a one-time, 30-day Pro trial per care profile in the app. This trial does not require payment, does not auto-renew, and does not bill your Apple ID or Google Play account. When the trial ends, that care profile returns to the Free tier unless you separately subscribe to paid Pro.
- Paid Pro: Ongoing Pro access for a care profile requires a paid subscription through the Apple App Store or Google Play (when available in your build). Pricing and renewal terms are shown before you subscribe.
Mobile purchases: Paid subscriptions are billed by Apple or Google under their terms. Manage or cancel paid subscriptions through your device account settings (Settings → Apple ID → Subscriptions on iOS).
We do not store full payment card numbers in Carevazo systems for mobile in-app purchases.
8. Providers and care team members
If you join a care team as a provider, teacher, respite caregiver, or other role, you agree to:
- Keep information confidential and use it only for care purposes
- Not share information outside your care role without authorization
- Acknowledge the confidentiality and "what you'll see" disclosures presented in-app
These obligations supplement, and do not replace, your professional, employer, or contractual duties.
9. Acceptable use and content
You retain responsibility for content you submit. You grant Carevazo a limited license to host, process, and display your content solely to provide the Service to you and your authorized care team.
We may suspend or terminate accounts that violate these Terms or pose a security or abuse risk.
10. Account termination and deletion
You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy and in-app settings.
We may suspend or terminate the Service or your account if you materially breach these Terms or if required by law.
Upon deletion, we will handle personal information as described in the Privacy Policy, subject to legal retention requirements (for example, security audit logs).
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREVAZO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or complete.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREVAZO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Indemnity
You agree to indemnify and hold harmless Carevazo from claims arising out of your misuse of the Service, your content, or your violation of these Terms or others' rights, except to the extent caused by our gross negligence or willful misconduct.
14. Changes
We may update these Terms. We will post the revised Terms with a new "Last updated" date and, where required, provide additional notice. Continued use after changes become effective constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. You agree that exclusive jurisdiction for disputes arising from these Terms or the Service lies in the state or federal courts located in Maricopa County, Arizona, unless applicable consumer protection law requires otherwise.
